Anonymous Order (Domain) Registration Agreement

Parties:

 

  • Privacy Protect Corp. (“Representative”)
  • The Client (“Registrant”)
  • NicNames, Inc. (“Registrar”)

 

Preamble:

This Agreement outlines the terms and conditions under which the Registrant may anonymously register and manage domain names through the Representative, facilitated by the Registrar. This service is designed to maintain the Registrant’s anonymity while ensuring compliance with all applicable legal and regulatory requirements.

 

1. Service Description and Registrant Obligations

  • The Registrant must provide a valid, confirmed email address to maintain a communication endpoint for any legal inquiries or actions.
  • The Registrant must provide their Country, and if residing in the United States, state, and zip code for taxation purposes.
  • The Registrant agrees to comply with all applicable local, state, and federal laws. Any misuse of the domain or associated services for illegal activities such as spamming, phishing, or other cybercrimes will result in immediate suspension pending further investigation.

 

2. Registrant Account Management and Security Measures

 

        •        Email Confirmation: The Registrant will receive a confirmation email upon registering a domain or placing any order. The Registrant must confirm their email by clicking the provided link to finalize the registration or order. Failure to confirm the email within the stipulated timeframe will result in suspension by NicNames, Inc.

        •        Email as Primary Communication Endpoint: The Registrant’s confirmed email serves as the primary communication endpoint for all verifications and notifications. To enhance account security, the registrant is encouraged to enable two-factor authentication (2FA).

        •        Crypto Wallet Authentication: The Registrant may use a cryptographic wallet, such as MetaMask, for secure authentication on the NicNames.com website, providing an additional layer of security.

 

3. Abuse Confirmation and KYC Verification

 

        •        Upon receipt of verified evidence or reports of illegal activity associated with the domain or services (“Confirmed Abuse”), the Representative or Registrar will immediately suspend the implicated services.

        •        To resolve the situation, the Registrant must undergo a Know Your Client (KYC) procedure within the timeframe specified in the suspension notice. Failure to comply will lead to termination of the services provided.

 

4. Legal Disclosure and Compliance

 

  • In compliance with legal obligations, including court orders or legal proceedings such as the Uniform Domain-Name Dispute-Resolution Policy (UDRP), the domain name or associated service will be suspended until the Registrant completes the KYC procedure.
  • Should the Registrant fail to complete KYC, or if they decline to participate in UDRP communications, their email address will be disclosed to the requesting party, and the domain name may be released or transferred to the party initiating the UDRP claim.

 

5. Taxation and Legal Nexus

 

  • The Registrant is responsible for all applicable taxes and fees as dictated by the geographic information provided.

 

6. Indemnification

 

  • The Registrant agrees to indemnify and hold harmless the Representative and the Registrar from any and all claims, liabilities, damages, or expenses arising from violations of this agreement or the law.

 

7. Duration and Termination

 

  • This Agreement is effective upon the Registrant’s acceptance and remains valid until terminated. Either party may terminate the agreement with thirty (30) days notice. Should the Registrant decide to terminate, they must convert all Anonymous contacts to regular contacts prior to termination. Non-compliance results in immediate termination by the Representative.

 

8. Automatic Acceptance and Usage in New Orders

 

  • Acceptance of this Agreement is mandatory at the time of creating an Anonymous contact, and the use of this contact in any new orders or services automatically applies this Agreement.
  • Should the Registrant choose not to accept, they may instead opt for regular contact with Privacy Protection to shield their information from Whois databases.

 

9. Governing Law

 

  • The laws of Delaware, USA, will govern this Agreement. All disputes arising under this Agreement will be subject to the exclusive jurisdiction of the courts located in Delaware.

 

10. Amendment

 

  • Any amendments to this Agreement must be made in writing and signed by all parties, reflecting mutual consent and continued compliance with legal standards.

 

11. Entire Agreement

 

  • This document represents the entire agreement between the parties regarding the subject matter herein and supersedes all prior communications.
